Arrendadora Actinver, S.A. de C.V. (“Actinver”) informs you, prior to collecting your personal data, of the following Privacy Notice to enable you to exercise your rights to informational self-determination, privacy, and the protection of your personal data:

P R I V A C Y  N O T I C E

A. Identity and Address of the Data Controller.

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP”), its regulations (the “Regulations”), and other applicable provisions, Arrendadora Actinver, S.A. de C.V. (hereinafter referred to as the “Controller” or “Actinver”), located at Montes Urales No. 620, P.B., Colonia Lomas de Chapultepec IV sección, Miguel Hidalgo Borough, Postal Code 11000, Mexico City, telephone: 01 (55) 86 36 55 50, informs you that it will implement all necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility during the processing of the personal data you provide.

B. Personal Data Collected and Subject to Processing.

The personal data you freely and voluntarily provide to Actinver by any means made available, through publicly accessible sources, or any other lawful source (collectively referred to as “Personal Data”), which at all times will consider your rights under the Law and Regulations, may include:
 
  1. Personal Data: Full name, address, telephone numbers, photograph, Taxpayer Identification Number (RFC), Voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, education level, email address, driver’s license number, academic and professional training, work experience, marital status, general information about family members (parents, siblings, spouse, children), employment details (current and previous), personal references, physical characteristics, biometric data (e.g., fingerprints, facial image), academic, labor, legal, and migration data, among other similar details.
  2. Financial and/or Asset Data: Housing Credit Number with the National Housing Fund for Workers (INFONAVIT), Retirement Fund Administrator (AFORE), affiliation with the IMSS, bank accounts and transactions, financial relationships, gross and net income, average monthly expenses, debts with third parties, owned or leased assets and their value, bank account numbers and electronic transfer codes (Clabe), among other similar details.
  3. Sensitive Data: Religious, social, civic, or cultural affiliation, blood type, weight, height, size, illnesses, current health status, tattoos, union membership, hobbies, entertainment preferences, and other similar details.
For consultation and verification purposes, as well as to ensure that the Personal Data you have freely provided is accurate and up to date, Actinver may collect information from personal references, work references, and other sources such as telephone directories, job boards, publicly available databases, among others.

C. Purposes of Processing.

The Personal Data we process in accordance with this Privacy Notice will be used solely to fulfill, first and foremost, the purposes inherent to negotiating and, where applicable, establishing a commercial relationship with you, as well as for the negotiations, planning, and execution of business and commercial activities we undertake with third parties or duly identified processors to whom we transmit this Privacy Notice for compliance. Secondly, it will also be used for purposes that are not necessarily related to the business relationship we maintain with you. These purposes are categorized into two groups for your information: 

a. Primary Purposes (Necessary):

  1. Management, control, administration and updating of information related to Actinver's clients and the legal representatives of clients (in the case of legal entities), necessary to execute and confirm transactions, enter into service agreements with Actinver, and ensure the security and confidentiality of operations.
  2. Analysis of the quality, creditworthiness, and payment capacity of Actinver's clients, in accordance with current and applicable legislation.
  3. Analysis of the profile and personal, employment, and financial background of Actinver's clients, in accordance with current and applicable legislation.
  4. Management, control, and administration of communications between Actinver and its clients.
  5. Monitoring, control, and evaluation of audits to ensure compliance actions established by national legislation, international laws, and international treaties to which Mexico is a party.
  6. Ensuring compliance with obligations related to confidentiality, integrity, and transparency, as well as legal provisions regarding anti-money laundering, counter-terrorism financing, and other sectoral regulations through the implementation of established administrative and technical procedures.
  7. Management, control, and administration of judicial or extrajudicial collection of services provided by Actinver.
  8. Customer service and follow-up on complaints and/or inquiries through communication channels established by Actinver for such purposes.
  9. Statistical and historical record-keeping of Actinver's clients and their legal representatives.

b. Secondary Purposes (Non-Necessary):

  1. Sending communications about offers and new products and/or services provided by Actinver.

  2. Sending commercial information and offers (electronic and physical) regarding products and/or services offered or produced by third parties.

  3. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver's business partners.

  4. Sending information about social events organized by Actinver.

  5. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you do not agree with the aforementioned purposes, please note that you have a period of no more than five (5) calendar days from the date this Privacy Notice is made available to you to express your refusal via email to our Personal Data Office, whose contact details are provided below.

The rights of the data owner to revoke consent or object to data processing remain unaffected if no refusal is expressed prior to the submission or use of the personal data.

D. Transfer of Personal Data.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients for the purposes identified below, as well as those stated in the previous section:
  1. Parent Companies, Affiliates, or Subsidiaries of Actinver: For centralized data storage, compliance with transparency and anti-money laundering obligations, as well as statistical and historical record-keeping of clients and their legal representatives.

  2. Public Entities: Federal, state, or municipal government bodies, commissions, institutes, and/or regulatory entities for compliance with transparency and anti-money laundering obligations, as well as judicial or administrative requirements issued by competent authorities.

  3. Organizations, Entities, or Authorities Abroad: For compliance with requirements or requests with effects in Mexican territory or enforceable under international treaties to which Mexico is a party.

  4. Financial Entities: For compliance with transparency, anti-money laundering, and other legal obligations.

  5. Third Parties (Commercial Alliances): Exclusively to provide additional products and/or services related to your contract.

E. Exercise of ARCO Rights.

In all legally permissible cases, you may exercise your rights to Access, Rectify, Cancel, and Oppose ("ARCO Rights") at any time through the procedures we have implemented.

The corresponding request must meet the requirements established by current legislation and be submitted in writing to our Personal Data Department located at Montes Urales No. 620, P.B., Colonia Lomas de Chapultepec IV sección, Alcaldía Miguel Hidalgo, C.P. 11000, Mexico City.

The request must include the following:

      I. Name and address of the owner, or another means to communicate the response to your request.
     II. Documents proving your identity or, where applicable, legal representation..
    III. A clear and precise description of the personal data for which you seek to exercise any of the ARCO Rights.
    IV. Any other element or document that facilitates the location of your personal data.
Actinver will inform you, within a maximum of twenty days from the date your request is received, of the decision made. If the request is valid, it will be enforced within fifteen business days following the notification of the response. If the information provided in your request is incorrect or insufficient, or if the required documents are not included to prove your identity or legal representation, Actinver will notify you within fifteen business days of receipt of your request to correct the deficiencies. In such cases, you will have ten business days to respond, starting the day after the request is received. If you do not respond within this period, the request will be considered not submitted.
You may obtain the requested information or personal data through simple copies, electronic documents in standard formats (Word, PDF, etc.), or any other legitimate means that guarantees and certifies the effective exercise of the requested right.

Alternatively, you may direct your request to Actinver’s Personal Data Department via email at unidad@actinver.com.mx, ensuring that all previously listed requirements are met. The subject of the communication should read "ARCO Rights and/or Consent Revocation," understanding that the procedure timelines will remain the same as mentioned in this section. If Actinver fails to respond within the timeframe established by the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, you may initiate an ARCO Rights protection procedure with the National Institute for Transparency, Access to Information and Protection of Personal Data (INAI), located at Insurgentes Sur No. 3211, Col. Insurgentes Cuicuilco, Delegación Coyoacán, C.P. 04530, Mexico City. This will be in accordance with the requirements provided by INAI at the appropriate time.

Actinver values the importance of keeping your personal data updated, accurate, and truthful. Therefore, we kindly ask you to notify us of any changes to your personal information at all times.

F. Revocation of Consent.

You may revoke your consent for the processing of your Personal Data at any time by sending an email to our Personal Data Department, clearly specifying the Personal Data, the purpose, and the activity you do not authorize us to carry out, provided this information is in our databases or files, or reasonably accessible to us.
The procedure for revoking consent, if applicable, will be the same as that established in the preceding section for exercising ARCO Rights

G. Limitations on the Use and Disclosure of Your Personal Data

You may limit the use or disclosure of your Personal Data by submitting a request to our Personal Data Department. The requirements to verify your identity, as well as the procedure to process your request, will be the same as those outlined in Section E of this Privacy Notice (Exercise of ARCO Rights).
Actinver has means and procedures in place to ensure the inclusion of some of your data in its internal exclusion lists when you expressly request it. Actinver will provide registered data owners with the corresponding proof of registration.

H. Modifications or Updates to This Privacy Notice

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time and at its sole discretion. In such cases, Actinver will communicate these changes through the following website: www.actinver.com in the section titled “Privacy Notices.”

Actinver will be required to provide a new Privacy Notice when, in its capacity as the Data Controller:

  1. Its identity changes.

  2. It needs to collect additional Sensitive, Asset, or Financial Personal Data not previously disclosed in this Privacy Notice, particularly when such data is not obtained directly from the data owner and requires their consent.

  3. It changes the purposes that originated or are necessary for the legal relationship between Actinver and the data owner, or new purposes are introduced that require the data owner's consent.

  4. It modifies the conditions for data transfers or plans to conduct transfers not initially foreseen that require the data owner's consent

This Privacy Notice complies with the requirements of the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, the Privacy Notice Guidelines, and other applicable legal provisions

  • I hereby express my consent for the processing of the Personal Data provided to Actinver to carry out the Primary or Necessary Purposes stated in this Privacy Notice, acknowledging that I have no objection to the transfer of Personal Data to the third parties mentioned herein.

  • I hereby express my consent for the Personal Data provided to Actinver to be used to carry out the Secondary or Non-Essential Purposes stated in this Privacy Notice, acknowledging that I have no objection to the transfer of Personal Data to the third parties mentioned herein.

  • I hereby express my consent for the Personal Data provided to Actinver to be used to contact me personally, by telephone, or via email for marketing, advertising, or commercial prospecting purposes exclusively by Actinverand/or its parent, affiliates, and/or subsidiaries, acknowledging that I have no objection to the transfer of Personal Data to the third parties mentioned herein.
