Banco Actinver, S.A., Multiple Banking Institution, Actinver Financial Group ("Actinver"), informs you, prior to collecting your Personal Data, so that you may exercise your rights to informational self-determination, privacy, and the protection of your Personal Data, the following:

P R I V A C Y  N O T I C E

A. Identity and Address of the Data Controller.

In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP”), its regulations (the “Regulation”), and other applicable legal provisions, Banco Actinver, S.A., Multiple Banking Institution, Actinver Financial Group (hereinafter referred to as the “Controller” or “Actinver”), whose address for all purposes related to this Privacy Notice is Montes Urales No. 620, P.B, Colonia Lomas de Chapultepec, Teléfono: 01 (55) 86 36 55 50, Alcaldía Miguel Hidalgo, C.P.: 11000, Mexico City, informs you that during the processing of the personal data you provide, we will implement the necessary measures to comply with the principles of legality, quality, consent, information, purpose, fairness, proportionality, and responsibility as established by the LFPDPPP and the Regulation.

B. Personal Data Collected and Subject to Processing.

The personal data that you freely and voluntarily provide to Actinver through any available means, or that we receive through public access sources or any other lawful source (hereinafter collectively referred to as "Personal Data"), may include the following, always considering the interests that assist you under the terms of the Law and the Regulation:
a. Personal Data: Full name, address, phone numbers, photograph, Taxpayer Identification Number (RFC), Voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, educational level, email address, driver's license number, professional and academic background, work experience, marital status, general family information (parents, siblings, spouses, children), current and past employment information, personal references, as well as other identification data, physical characteristics, biometric data (such as fingerprints, facial images), academic data, legal data, migratory data, and other similar data exclusively under this category.
The personal data of third parties that you provide to Actinver to fulfill the identified purposes or secondary purposes (e.g., family or beneficiary data) must be provided only after informing them about the processing of their data and the contents of this Privacy Notice.
b. Financial and/or Asset Data: Housing Credit Number with the National Workers Housing Fund Institute (INFONAVIT), Retirement Fund Administrator (AFORE), affiliation with the Mexican Social Security Institute (IMSS), bank accounts and/or transactions, financial relationships, gross and/or net income, average monthly expenses, debts with third parties, movable and immovable property owned or leased and their value, bank account number(s) and "Clabe" account numbers for electronic transfers, and other similar data exclusively under this category.
c. Sensitive Data: Religious, social, civic, or cultural affiliations, blood type, weight, height, size, medical conditions, current health status, tattoos, union membership, hobbies, entertainment, and other similar data exclusively under this category.
For consultation and verification purposes, as well as to ensure that the Personal Data you have freely provided is accurate and up to date, Actinver may collect information from personal references, work references, and other sources such as telephone directories, job boards, publicly available databases, among others.

C. Purposes of Data Processing.

The Personal Data we process under this Privacy Notice will be used solely to comply, in the first instance, with the purposes inherent to negotiating and concluding, where appropriate, the commercial relationship with you, as well as negotiations, planning, and execution of commercial activities with third parties or identified processors, to whom we transmit this Privacy Notice for compliance. In the second instance, your Personal Data will be used for purposes not necessarily related to the employment relationship we have with you, which are divided into two categories for your information:

a. Primary Purposes or Necessary Purposes:

  1. Management, control, administration, and updating of information related to clients and the legal representatives of clients (in the case of legal entities) of Actinver, necessary for executing and confirming transactions, contracting services with Actinver, and ensuring the security and confidentiality of transactions.

  2. Analysis of the quality, creditworthiness, and payment capacity of Actinver clients, in accordance with applicable laws.

  3. Analysis of the profile, personal, work, and financial background of Actinver clients, in accordance with applicable laws.

  4. Management, control, and administration of communications between Actinver and its clients.

  5. Monitoring, control, and evaluation of audits to ensure compliance with national legislation, international regulations, and international treaties to which Mexico is a party.

  6. Ensuring compliance with confidentiality, integrity, and transparency obligations, as well as legal provisions on the prevention of money laundering and terrorist financing, through the implementation of administrative and technical procedures established for these purposes.

  7. Management, control, and administration of judicial or extrajudicial collections of services provided by Actinver.

  8. Customer service and follow-up on complaints and/or clarifications through the communication channels established by Actinver for these purposes.

  9. Statistical analysis and historical record of clients and their legal representatives.

  10. Verification of the client's identity with respect to the information on official identification documents issued by the National Electoral Institute and/or other public institutions responsible for such validations or verifications, including biometrics linked to these documents, to confirm the client's identity and ensure there is no identity theft.

  11. Collection of biometric information to store this data for verification and cross-checking, in compliance with applicable legal provisions that ensure the security of transactions made by the client.

b. Secondary Purposes or Non-Essential Purposes:

  1. Sending communications regarding offers and new products and/or services provided by Actinver.

  2. Sending commercial information and offers (both electronic and physical) regarding products and/or services offered or produced by third parties.

  3. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver’s parent companies, affiliates, or subsidiaries.

  4. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver’s business partners.

  5. Sending information about social events organized by Actinver.

  6. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you disagree with the aforementioned purposes, please be informed that you have a period of no more than five (5) calendar days from the date this Privacy Notice is made available to inform us of your objection via email to our Personal Data Office, whose contact information is provided below.
The rights of the data subject to revoke consent or object to the processing of their personal data remain unaffected if no objection is made prior to providing or utilizing the data.

D. Transfers of Personal Data.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients and for the purposes identified below, as well as those outlined in the previous section:
  1. Parent companies, affiliates, or subsidiaries of Actinver: for the centralized storage of information; compliance with informational obligations, transparency, and anti-money laundering measures; as well as statistical purposes and historical client records.

  2. Public Bodies: federal, state, or municipal public administrations; Commissions; Institutes and/or Regulatory Entities: for compliance with informational obligations, transparency, and anti-money laundering measures; as well as compliance with judicial or administrative requests issued by competent authorities.

  3. Foreign entities, organizations, or authorities: for compliance with requests or requirements affecting Mexican territory, or enforceable under international treaties to which Mexico is a party.

  4. Financial Entities: for compliance with informational obligations, transparency, anti-money laundering measures, and other legal provisions.

  5. Service Providers: to assist Actinver in performing services related to your contract, as well as for the compliance with judicial or administrative requests issued by competent authorities.

  6. Third Parties (commercial alliances): exclusively for providing additional products and/or services related to your contract.

E. Exercising ARCO Rights

In all legally applicable cases, you may exercise your rights of access, rectification, cancellation, and/or opposition ("ARCO Rights") at any time through the procedures we have implemented.
The corresponding request must comply with the requirements established by current legislation and be addressed in writing to our Personal Data Department at the following address: Montes Urales No. 620, Floor 1, Lomas de Chapultepec, Phone: (55) 86 36 55 50, Alcaldía: Miguel Hidalgo, C.P. 11000, Mexico City.
The request should contain and be accompanied by the following:
       I. Name and address of the data subject, or another means to communicate the response to the request.
      II. Documents verifying the identity or, if applicable, the legal representation.
     III. A clear and precise description of the personal data for which the ARCO rights are to be exercised

     IV. Any other element or document that facilitates the location of your personal data.

Actinver will notify you, within a maximum period of twenty days from the receipt of the request, of the decision made. If the request is granted, it will be effective within the next fifteen working days after Actinver communicates the response. If the information provided in the request is incorrect or insufficient, or if the necessary documents to verify your identity or legal representation are not provided, Actinver will request the deficiencies to be rectified within the following fifteen working days. You will have ten working days to address the rectification request from the day you receive it. If you do not respond within this period, the request will be considered not submitted.
You may obtain the requested personal data through simple copies, electronic documents in conventional formats (Word, PDF, etc.), or through any other legitimate means that guarantees and certifies the effective exercise of the requested right.
Alternatively, you can direct your request to Actinver's Personal Data Department at the email address unidad@actinver.com.mx or visit one of our financial centers for guidance, always ensuring that you meet the requirements listed above. If Actinver does not respond to your request within the period set by the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, you may initiate the ARCO Rights protection procedure before the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI), located at Insurgentes Sur No. 3211, Col. Insurgentes Cuicuilco, Coyoacán, C.P. 04530, Mexico City, as per the requirements provided by the Institute.
It is important for Actinver to keep your personal data updated and ensure its accuracy, validity, and precision. We appreciate you informing us of any changes to your data.

F. Revocation of Consent.

You may revoke your consent for the processing of your personal data at any time by sending an email to our Personal Data Department, clearly specifying the personal data, the purpose, and the activity you do not authorize us to carry out, as long as this data is in our databases or files, or is reasonably accessible.
The process for revoking consent will be the same as that for exercising ARCO rights, as described in the previous section.

G. Limitations on the Use and Disclosure of Your Personal Data.

You may limit the use or disclosure of your personal data by sending a request to our Personal Data Department. The requirements to verify your identity, as well as the procedure to address your request, will be the same as those outlined in section E (Exercise of ARCO Rights).
Actinver has procedures and means to include some of your data in its exclusion lists when you expressly request to be included. Actinver will issue a certificate of registration to individuals whose data has been included in these lists.

Modifications or Updates to this Privacy Notice.

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time, at its sole discretion. In such cases, Actinver will communicate these changes through the following website address: www.actinver.com in the section called "Privacy Notices."
Actinver is required to provide a new Privacy Notice when it, as the Data Controller:
  1. Changes its identity;

  2. Needs to collect additional Sensitive, Financial, or Property Data not previously mentioned in this Privacy Notice, especially when such data is not collected personally or directly from the data subject and requires their consent;

  3. Changes the purposes that gave rise to or are necessary for the legal relationship between Actinver and the data subject; or if new purposes are added that require the consent of the data subject;

  4. Modifies transfer conditions or intends to make transfers not initially foreseen, and the consent of the data subject is required.

This Privacy Notice complies with the requirements set forth by the Federal Law on the Protection of Personal Data Held by Private Parties, the Federal Regulation on the Protection of Personal Data Held by Private Parties, the Guidelines for Privacy Notices, and other applicable legal provisions.
