Banco Actinver, S.A., Institución de Banca Múltiple, Grupo Financiero Actinver (“Actinver”), hereby informs you, prior to obtaining your Personal Data, so that you may exercise your rights to informational self-determination, privacy, and the protection of your Personal Data, of the following:

P R I V A C Y  N O T I C E - Clients

A. Identity and Address of the Data Controller.

In accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (the “LFPDPPP”), its regulations (the “Regulations”), and other applicable legal provisions, Banco Actinver, S.A., Institución de Banca Múltiple, Grupo Financiero Actinver (hereinafter referred to as the “Data Controller” or “Actinver,” interchangeably), with its address for all applicable purposes of this Privacy Notice located at Montes Urales No. 620, Ground Floor, Colonia Lomas de Chapultepec, Miguel Hidalgo Borough, C.P. 11000, Mexico City, and phone number (55) 1103 6699, informs you that during the processing of the personal data you provide, we will implement the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility established by the LFPDPPP and its Regulations.

B. Personal Data Collected and Processed.

The personal data you freely and voluntarily provide to Actinver through any medium we make available, that reaches us through publicly accessible means, or is obtained from any other lawful source (hereinafter collectively referred to as "Personal Data"), and always considering your rights under the Law and Regulations, may include:
a. Personal Data: Full name, address, phone numbers, photograph, Federal Taxpayer Registry (RFC), Voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, education level, email address, driver’s license number, professional and academic background, work experience, marital status, general information about family members (parents, siblings, spouse, children), current and past employment data, personal references from third parties, and other identification data. This category also includes physical characteristics, biometric data (such as fingerprints and facial image), academic data, employment data, legal data, immigration data, and similar data.
Personal data of third parties provided by you to Actinver for achieving identified purposes or secondary purposes (e.g., family member or beneficiary data) must be provided after informing such individuals about the processing of their personal data and the content of this Privacy Notice.
b. Financial and/or Asset Data: Credit Housing Number with the National Workers' Housing Fund Institute (INFONAVIT), Retirement Fund Administrator (AFORE) affiliation, affiliation to the Mexican Social Security Institute (IMSS), banking accounts and/or transactions, asset relationships, gross and/or net income, average monthly expenses, debts with third parties, owned or rented movable and immovable property and their value, bank account number(s), and electronic transfer account number(s) (CLABE), and similar data within this category.
c. Sensitive Data: Religious, social, civic, or cultural affiliations; blood type; weight; height; clothing size; illnesses; current health status; tattoos; union membership; hobbies; entertainment and recreational activities, and similar data within this category.
For consultation and verification purposes, and to ensure that the Personal Data you have freely provided is accurate and up to date, Actinvermay collect information from personal references, employment references, and other sources such as telephone or employment directories, job boards, publicly available databases, among others.

C. Purposes of Data Processing.

The Personal Data processed under this Privacy Notice will be used exclusively to fulfill, primarily, the purposes inherent to negotiating and establishing, if applicable, the commercial relationship with you. This includes negotiations, planning, and execution of business and commercial activities carried out with third parties or specifically identified data processors to whom this Privacy Notice is transmitted for compliance. Secondarily, it will address purposes unrelated to the employment relationship we may have with you, categorized for your information as follows:

a. Primary Purposes or Necessary Purposes:

  1.

Management, control, administration, and updating of information related to Actinver's clients and legal representatives (in the case of corporate entities), necessary for conducting and confirming transactions, contracting services with Actinver, and ensuring the security and confidentiality of operations.

  3. Analysis of Actinver clients’ quality, creditworthiness, and payment capacity in compliance with applicable legislation.

  4. Evaluation of clients' personal, employment, and financial background under applicable legislation.

  5. Management, control, and administration of communications between Actinver and its clients.

  6. Monitoring, control, and evaluation through audits to ensure compliance with national and international legal and treaty obligations.

  7. Ensuring adherence to confidentiality, integrity, and transparency obligations, as well as compliance with anti-money laundering and anti-terrorism financing regulations and other sectoral norms, by implementing administrative and technical procedures.

  8. Management and administration of judicial or extrajudicial collection of services provided by Actinver.

  9. Customer service and follow-up on complaints and/or clarifications through Actinver's established communication channels.

  10. Statistical and historical record-keeping of Actinver’s clients and their legal representatives.

  11. Identity verification of clients based on the information in their official identification issued by the National Electoral Institute (INE) and/or other public institutions responsible for such validations, including related biometrics, to confirm identity and prevent impersonation.

  12. Collection and storage of biometric information to perform necessary verifications and comparisons, in compliance with applicable legal provisions ensuring transaction security.

b.Secondary Purposes or Non-Necessary Purposes:

  1. Sending communications regarding offers and new products and/or services provided by Actinver.

  2. Sending commercial information and offers (electronic and physical) related to products and/or services offered or produced by third parties.

  3. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver’s parent companies, affiliates, or subsidiaries.

  4. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver's business partners.

  5. Sending information about social events organized by Actinver.

  6. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you disagree with the above-mentioned purposes, you have up to five (5) calendar days from the date this Privacy Notice is made available to express your objection via email to our Specialized Unit, whose details are provided later in this document.
You retain the right to revoke your consent or object to data processing at any time. If you do not object to the processing of your data before providing it, your consent will be considered granted.

D. Data Transfers.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients and for the purposes outlined below, as well as those mentioned in the previous section:
  1. Parent Companies, Affiliates, or Subsidiaries of Actinver: For centralized information storage, compliance with information, transparency, and anti-money laundering obligations, and statistical and historical client record-keeping.

  2. Public Agencies, Federal, State, or Municipal Administrations, Commissions, Institutes, and/or Regulatory Entities: To comply with information, transparency, and anti-money laundering obligations, as well as judicial or administrative requirements issued by competent authorities.

  3. Foreign Organizations, Entities, or Authorities: To fulfill requirements or requests with effects in Mexican territory or enforceable under international treaties to which Mexico is a party.

  4. Financial Entities: For compliance with information, transparency, anti-money laundering obligations, and other legal provisions.

  5. Service Providers: To assist Actinver in executing services related to your contract and ensuring compliance with judicial or administrative requirements issued by competent authorities.

  6. Third Parties (Commercial Partnerships): Exclusively to provide additional products and/or services related to your contract.

Actinver commits not to transfer your personal information to third parties without your consent, except as permitted by the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, and will conduct such transfers in accordance with these legal provisions. If you do not express opposition to the transfer of your personal data, your consent will be considered granted. 

If Actinver does not respond to your request within the timeframe established by the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, you may initiate the ARCO rights protection procedure with the National Institute for Transparency, Access to Information, and Personal Data Protection (INAI) at Insurgentes Sur No. 3211, Colonia Insurgentes Cuicuilco, Delegación Coyoacán, C.P. 04530, Mexico City, subject to the requirements outlined by the Institute.


         I consent to the transfer of my personal data. 
For Actinver, it is important to keep your personal data updated and ensure its accuracy, validity, and correctness. Therefore, we kindly ask you to inform us of any changes to your data at all times.

E.  Exercise of ARCO Rights

In all legally applicable cases, you may exercise your rights of Access, Rectification, Cancellation, and/or Opposition ("ARCO Rights") at any time through the procedures we have implemented.
The request must comply with the requirements established by current legislation and be submitted in writing to the Specialized Unit at Montes Urales No. 620, Floor 1, Colonia Lomas de Chapultepec, Miguel Hidalgo Borough, C.P. 11000, Mexico City, by phone at (55) 1103 6699, or via email at unidad@actinver.com.mx
The request must include the following:
I. Nombre y domicilio del titular, u otro medio para comunicarle la respuesta a su solicitud.
II. Los documentos que acrediten su identidad o, en su caso, la representación legal.
III. La descripción clara y precisa de los datos personales respecto de los que se busca ejercer alguno de los Derechos ARCO; y
IV. Cualquier otro elemento o documento que facilite la localización de sus datos personales.
Actinver will inform you of the determination adopted via the email you provide within a maximum of 20 business days from the date the request is received. If the request is valid, it will be implemented within 15 business days following the notification. If the information provided in your request is incorrect, insufficient, or missing necessary documents to prove your identity or legal representation, Actinver will notify you within 15 business days of receiving your request, asking for corrections. You will have ten business days to address these corrections starting the day after you receive the notification. If you fail to respond within this timeframe, your request will be considered not submitted.

You can obtain the requested information or personal data through simple copies, electronic documents in standard formats (Word, PDF, etc.), or any other legitimate means that guarantee the effective exercise of the requested right.

Ensure all requirements listed above are met, and specify “ARCO Rights and/or Consent Revocation” as the subject line. The process timelines will remain as stated above. If Actinver does not respond to your request within the period specified in the Federal Law on Protection of Personal Data Held by Private Parties and its Regulations, you may initiate an ARCO Rights protection procedure with the National Institute for Transparency, Access to Information, and Personal Data Protection (INAI) at Insurgentes Sur No. 3211, Colonia Insurgentes Cuicuilco, Coyoacán Borough, C.P. 04530, Mexico City, subject to the requirements provided by the Institute.

For Actinver, it is important to keep your personal data updated and ensure its accuracy, validity, and correctness. Please inform us of any changes to your data at all times.

F. Consent Revocation.

You may revoke your consent for the processing of your personal data at any time by emailing our Specialized Unit. Clearly specify the personal data, purpose, and activity you do not authorize to be carried out, provided they are within our databases or files or within our reasonable access.
The procedure for revoking consent, if applicable, will follow the same steps outlined in the previous section for exercising ARCO Rights.

G. Limitations on the Use and Disclosure of Your Personal Data.

You may limit the use or disclosure of your personal data by submitting a request to our Personal Data Department. The requirements to verify your identity and the procedure for processing your request will be the same as those stated in Section E of this Privacy Notice (Exercise of ARCO Rights).

Actinver has mechanisms and procedures to ensure the inclusion of your data in our exclusion lists upon your explicit request. Registered individuals will receive the corresponding registration confirmation.

 

Modifications or Updates to this Privacy Notice.

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time and at its sole discretion. In such cases, Actinver will communicate these changes through the following website: www.actinver.com, in the section labeled "Privacy Notices."
Actinver is required to provide a new Privacy Notice when Actinver, as the Data Controller:
  • a.    Changes its identity;
  • b. Needs to collect additional Sensitive, Financial, or Asset-related Personal Data beyond what is outlined in this Privacy Notice, especially if such data is not obtained directly from the data subject and requires their consent;

  • c. Changes the purposes that originated or are necessary for the legal relationship between Actinver and the data subject, or if new purposes are introduced that require the data subject's consent; or

  • d. Modifies the conditions of data transfers or intends to carry out transfers that were not initially planned, and the data subject's consent is necessary.

This Privacy Notice complies with the requirements of the Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, as well as the Guidelines for Privacy Notices and other applicable legal provisions.

  • I hereby consent for my Personal Data provided to Actinver to be used to contact me personally, via phone or email, for marketing, advertising, or commercial prospecting purposes solely by Actinver and/or its parent, affiliates, and/or subsidiaries, acknowledging that I have no objections to the transfer of my Personal Data to the third parties mentioned in the same.
