OPERADORA ACTINVER, S.A. DE C.V., SOCIEDAD OPERADORA DE FONDOS DE INVERSIÓN, GRUPO FINANCIERO ACTINVER (“Actinver”) informs you, prior to obtaining your Personal Data and with the aim of enabling you to exercise your rights to informational self-determination, privacy, and protection of your Personal Data, of the following:

P R I V A C Y  N O T I C E

A. Identity and Address of the Controller.

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP), its Regulations, and other applicable legal provisions, OPERADORA ACTINVER, S.A. DE C.V., SOCIEDAD OPERADORA DE FONDOS DE INVERSIÓN, GRUPO FINANCIERO ACTINVER (hereinafter referred to as the “Controller” or “Actinver”) establishes its address for all matters related to this Privacy Notice at Address: Montes Urales No. 540, P.B., Colonia Lomas de Chapultepec, Alcaldía Miguel Hidalgo, C.P. 11000, Ciudad de México. Telephone: 01 (55) 86 36 55 50. Actinver will implement the necessary measures to ensure compliance with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and accountability outlined in the LFPDPPP and its Regulations while processing the personal data you provide.

B. Personal Data Collected and Subject to Processing.

The Personal Data that you voluntarily provide to Actinver through any means made available or obtained from public sources or other lawful sources (hereinafter collectively referred to as “Personal Data”) may include the following categories:
a. Personal Data: This includes full name, address, phone numbers, photograph, Federal Taxpayer Registry (RFC), Voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, education level, email address, driver’s license number, academic and professional background, work experience, marital status, general information about family members (parents, siblings, spouse, children), current and previous employment data, third-party personal references, as well as other identification details, physical characteristics, biometric data (such as fingerprints or facial images), academic data, work data, legal data, migratory data, and other similar information exclusively within this category.
The personal data of third parties that you provide to Actinver for the fulfillment of identified purposes or secondary purposes (e.g., family members or beneficiaries) must be shared only after you have informed them about the processing of their personal data and the content of this Privacy Notice.
b. Financial and/or Asset Data: This includes housing credit numbers with the National Workers' Housing Fund Institute (INFONAVIT), Retirement Fund Administrators (AFORE), affiliation with the Mexican Social Security Institute (IMSS), bank accounts and/or transactions, financial relationships, gross and/or net income, average monthly expenses, debts with third parties, owned or rented assets and their value, bank account numbers and CLABE numbers for electronic transfers, and other similar information exclusively within this category.
c. Sensitive Data: This includes religious, social, civic, or cultural affiliations; blood type; weight; height; clothing size; health conditions; illnesses; current health status; tattoos; union membership; hobbies, entertainment, and recreation activities; and other similar data exclusively within this category.
For consultation and verification purposes, and to ensure the accuracy and up-to-date status of the Personal Data you have freely provided, Actinver may collect information from personal references, professional references, and other sources such as public or employment directories, job boards, public databases, among others.

C. Purposes of Data Processing.

The Personal Data processed under this Privacy Notice will be used solely to fulfill, primarily, the purposes inherent to negotiating and establishing, if applicable, a commercial relationship with you, as well as negotiations, planning, and execution of business activities conducted with third parties or authorized processors who are fully identified and to whom this Privacy Notice is transmitted for compliance. Secondly, your Personal Data may be used for purposes not necessarily related to the business relationship, which are categorized as follows for your reference:

a. Primary Purposes or Necessary Purposes:

  1. Management, control, administration, and updating of information related to Actinver's clients and the legal representatives of its clients (if legal entities), necessary to execute and confirm transactions, contract services, and ensure the security and confidentiality of operations.

  2. Analysis of the quality, creditworthiness, and payment capacity of Actinver’s clients, in accordance with applicable legislation.

  3. Review of personal, professional, and financial backgrounds of Actinver clients, following applicable legal requirements.

  4. Management, control, and administration of communications between Actinver and its clients.

  5. Monitoring, control, and evaluation through audits to ensure compliance with national and international legislation and treaties to which Mexico is a party.

  6. Ensuring confidentiality, integrity, and transparency obligations, as well as compliance with legal provisions for money laundering prevention, counter-terrorism financing, and sector-specific regulations, through the implementation of technical and administrative procedures.

  7. Management, control, and administration of judicial or extrajudicial debt collection for services rendered by Actinver.

  8. Customer service and follow-up on complaints or inquiries through established communication channels.

  9. Statistical and historical records of Actinver’s clients and their legal representatives.

b. Secondary Purposes or Non-Necessary Purposes:

  1. Sending communications about offers and new products or services provided by Actinver.

  2. Distribution of commercial information and offers (both electronic and physical) regarding products and services offered by third parties.

  3. Promotion, distribution, marketing, and sale of products or services offered by Actinver's parent companies, affiliates, or subsidiaries.

  4. Promotion, distribution, marketing, and sale of products or services offered by Actinver’s business partners.

  5. Sharing information about social events organized by Actinver.

  6. Sharing information on recreational, educational, or cultural activities organized by Actinver.

If you disagree with the secondary purposes mentioned above, you will have a maximum period of five (5) calendar days from the date this Privacy Notice is made available to you to express your refusal by sending an email to our Data Privacy Office, whose contact information is provided below.
Your right to withdraw consent or object to the processing of your data at a later stage remains intact, provided your refusal is communicated before the data is processed or utilized.

D. Data Transfers.

Your personal data may be transferred nationally or internationally to the following recipients and for the purposes listed below:
  1. Parent companies, affiliates, or subsidiaries of Actinver: For centralized information storage, compliance with transparency and anti-money laundering obligations, and for statistical and historical record purposes.

  2. Public Bodies: Including federal, state, or municipal administrations, commissions, institutes, and regulatory entities, to fulfill informational, transparency, and anti-money laundering obligations and comply with judicial or administrative requirements issued by competent authorities.

  3. Foreign entities, organizations, or authorities: To comply with enforceable requirements or requests within Mexican territory, or as required by international treaties to which Mexico is a party.

  4. Financial entities: To comply with transparency, anti-money laundering, and other legal obligations.

  5. Service providers: To assist Actinver in executing services related to your contract and ensuring compliance with judicial or administrative requirements issued by competent authorities.

  6. Third parties (commercial alliances): Exclusively to offer you additional products or services related to your contract.

E. Exercise of ARCO Rights.

You may exercise your rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights) whenever legally applicable, through the procedures we have established.
To submit a request, you must comply with the requirements set out by applicable legislation by writing to our Data Privacy Department at Montes Urales No. 540, Piso 1, Colonia: Lomas de Chapultepec, Miguel Hidalgo, C.P. 11000, Mexico City.
Your request must include:
    I. Your full name and address, or an alternative method for receiving our response.
   II. Documents proving your identity or, if applicable, legal representation.
  III. A clear and precise description of the personal data for which you wish to exercise ARCO rights
  IV. Any other information that may help us locate your personal data.
Actinver will communicate its decision within a maximum period of twenty (20) days, counted from the date it receives the corresponding request. If the request is deemed valid, it will be executed within fifteen (15) business days following the date Actinver communicates its response. If the information provided in your request is incorrect or incomplete, or if the necessary documents to prove your identity or legal representation are not included, Actinver will, within fifteen (15) business days from receiving your request, require you to correct these deficiencies to proceed with the request. In such cases, you will have ten (10) business days to address the request for corrections, counted from the day after you receive it. If you do not respond within this period, your request will be considered as not submitted.
You may obtain the requested information or personal data through simple copies, electronic documents in standard formats (Word, PDF, etc.), or any other legitimate means that guarantees and certifies the effective exercise of the requested right.
Alternatively, you may submit your request to Actinver's Data Privacy Department at the email address unidad@actinver.com.mx, or visit any financial centers where entities of Grupo Financiero Actinver are located. In any case, you must meet all the requirements outlined above and include “ARCO Rights and/or Withdrawal of Consent” as the subject of your communication. The timeframes for processing the request will remain the same as those mentioned in this section. If the period established by the Federal Law on Protection of Personal Data Held by Private Parties and its regulations elapses without Actinver responding to your request, you may initiate the ARCO Rights protection procedure before the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI), located at Insurgentes Sur No. 3211, Col. Insurgentes Cuicuilco, Coyoacán, C.P. 04530, Mexico City. This should be done following the requirements communicated to you by the Institute at the appropriate time.
Actinver emphasizes the importance of keeping your personal data updated, as well as ensuring its accuracy, validity, and authenticity. We kindly ask that you inform us of any changes to your data at all times.

F. Revocation of Consent.

You may revoke your consent for the processing of your Personal Data at any time by sending an email to our Data Privacy Department, clearly specifying the Personal Data, purpose, and activity you do not authorize us to perform, provided such data is in our databases or files, or is within our reasonable access.
The procedure for revoking consent, if applicable, will be the same as the one outlined in the previous section for exercising ARCO Rights.

G. Limitations on the Use and Disclosure of Your Personal Data.

You may limit the use or disclosure of your Personal Data by submitting the corresponding request to our Data Privacy Department. The requirements to verify your identity, as well as the procedure to address your request, will be the same as those outlined in Section E of this Privacy Notice (Exercising ARCO Rights).
Actinver has mechanisms and procedures in place to ensure the inclusion of some of your data in its own exclusion lists when you explicitly request such inclusion. Actinver will provide registered holders with the corresponding proof of registration.

H. Modifications or Updates to This Privacy Notice.

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time, at its sole discretion. In such cases, Actinver will communicate these changes via the following website: www.actinver.com, in the section titled "Privacy Notices."
Actinver is obligated to make a new Privacy Notice available to you when:
  1. Actinver, in its role as the Data Controller, changes its identity.

  2. Actinver needs to collect additional Sensitive, Asset, or Financial Personal Data beyond those informed in this Privacy Notice, when such data is not obtained personally or directly from the data subject and requires their consent.

  3. The purposes that originated or are necessary for the legal relationship between Actinver and the data subject are modified, or new purposes requiring consent are added.

  4. The conditions for data transfers are modified, or unanticipated transfers requiring consent are to be carried out

This Privacy Notice complies with the requirements established by the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, the Guidelines for Privacy Notices, and other applicable legal provisions.

  • I consent to the use of the Personal Data provided to Actinver for the Secondary or Non-Necessary Purposes outlined in this Privacy Notice, acknowledging that I have no objections to the transfer of Personal Data to the third parties mentioned herein.

  • I consent to the use of the Personal Data provided to Actinver to be contacted personally, via telephone, or through email for marketing, advertising, or commercial prospecting purposes exclusively by Actinver and/or its affiliated or subsidiary parent companies, acknowledging that I have no objections to the transfer of Personal Data to the third parties mentioned herein.
