Corporación Actinver, S.A.B. de C.V. ("Actinver") informs you, prior to obtaining your Personal Data, so that you can exercise your rights to informational self-determination, privacy, and protection of your Personal Data, as follows:

P R I V A C Y  N O T I C E

A. Identity and Address of the Data Controller.

In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the "LFPDPPP"), its regulation (the "Regulation"), and other applicable provisions, Corporación Actinver, S.A.B. de C.V.(hereinafter, the "Data Controller" or "Actinver," interchangeably), with the address for all purposes related to this Privacy Notice and any other related matters, located at Lomas de Chapultepec, IV Section, Phone: 01 (55) 86 36 55 50, Miguel Hidalgo Borough, ZIP code 11000, Mexico City, informs you that during the processing of the personal data you provide, we will implement the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility as outlined in the LFPDPPP and the Regulation regarding the personal data you provide.

B. Personal Data Collected and Subject to Processing.

The personal data that you freely and voluntarily provide to Actinver by any means we make available to you, or that reaches us through public access sources, or by any other lawful means (hereinafter and collectively referred to as "Personal Data"), considering at all times your interests under the Law and the Regulation, may include:
a. Personal Data: full name, address, phone numbers, photograph, Federal Taxpayer Registry (RFC), Voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, level of education, email address, driver's license number, professional and academic background, work experience, marital status, general information about relatives (parents, siblings, spouses, children), data about current and past employment, personal references from third parties, as well as other identifying data, physical characteristics, biometric data (such as fingerprints, facial image), academic data, work data, legal data, immigration data, and other similar data strictly under this category.
Personal data of third parties provided by you to Actinver for the fulfillment of the identified purposes or secondary purposes (for example, family or beneficiary data) must be provided after you have informed them about the existence of the processing of their personal data and the content of this Privacy Notice.
b. Financial and/or Property Data: Housing Credit number with the National Housing Fund for Workers (INFONAVIT), Retirement Fund Administrator (AFORE), affiliation with the Mexican Social Security Institute (IMSS), bank accounts and/or transactions, property relations, gross and/or net income, average monthly expenses, debts with third parties, owned or rented movable and immovable property and its value, bank account number(s) and "Clabe" account number(s) for electronic transfers, and similar data strictly under this category.
c. Sensitive Data: religious, social, civic, or cultural affiliation, blood type, weight, height, clothing size, illnesses, current health status, tattoos, union affiliation, hobbies, entertainment, and other similar data strictly under this category.
For consultation and verification purposes, as well as to ensure that the Personal Data you have freely provided is correct and up to date, Actinver may collect information from personal references, work references, and other sources such as telephone or work directories, job boards, public databases, among others.

C. Purposes of Processing.

The Personal Data we process according to this Privacy Notice will be used solely to fulfill, primarily, the purposes inherent in negotiating and, if applicable, establishing a business relationship with you, as well as negotiating, planning, and carrying out business and commercial activities with third parties or identified contractors to whom we transmit this Privacy Notice for compliance, and, secondarily, for purposes that do not necessarily relate to the employment relationship we maintain with you. These purposes are divided into two categories for your information:

a. Primary Purposes or Necessary Purposes:

  1. Management, control, administration, and updating of information related to clients and legal representatives of clients (in the case of legal entities) of Actinver, necessary to confirm and carry out operations, contract services with Actinver, and ensure the security and confidentiality of transactions.

  2. Analysis of the quality, creditworthiness, and payment capacity of Actinver's clients, in accordance with applicable legislation.

  3. Analysis of the personal, work, and financial profile and background of Actinver's clients, in accordance with applicable legislation.

  4. Management, control, and administration of communications between Actinver and its clients.

  5. Monitoring, control, and evaluation of audits to ensure compliance with national, international legislation, and international treaties that Mexico is a part of.

  6. Ensuring compliance with confidentiality, integrity, and transparency obligations, as well as legal provisions on anti-money laundering and combating the financing of terrorism, and other sectorial regulations, through the implementation of established administrative and technical procedures.

  7. Management, control, and administration of judicial or extrajudicial collection of services provided by Actinver.

  8. Customer service and follow-up to complaints and/or clarifications through the communication channels established for these purposes by Actinver.

  9. Statistics and historical records of clients and legal representatives of clients of Actinver.

b. Secondary Purposes or Non-Necessary Purposes:

  1. Sending communications regarding offers and new products and/or services provided by Actinver.

  2. Sending information and commercial offers (electronic and physical) about products and/or services offered or produced by third parties.

  3. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver's parent companies, affiliates, or subsidiaries.

  4. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver's business partners.

  5. Sending information about social events organized by Actinver.

  6. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you do not agree with the aforementioned purposes, we inform you that you have up to five (5) natural days from the date this Privacy Notice is made available to you to inform us of your refusal via email to our Personal Data Office, whose contact information is provided later.
The data subject's rights to revoke consent or object remain protected if you do not express your refusal to the processing of your personal data, prior to the delivery or use of such data.

D. Personal Data Transfers.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients and for the purposes identified below, as well as those outlined in the previous section:
  1. Parent companies, affiliates, or subsidiaries of Actinver; for the purposes of centralized information safeguarding, compliance with informational obligations, transparency, and anti-money laundering, as well as for statistical and historical record-keeping purposes for clients and their legal representatives.

  2. Public entities; federal, state, or municipal public administrations; commissions; regulatory institutes and/or entities; for the fulfillment of informational obligations, transparency, and anti-money laundering regulations; as well as to comply with judicial or administrative requirements issued by competent authorities.

  3. Foreign organizations, entities, or authorities; to comply with requirements or requests with effects in Mexican territory or enforceable under international treaties to which Mexico is a party.

  4. Financial entities; to comply with informational obligations, transparency, anti-money laundering regulations, and other legal provisions.

  5. Service providers; for the purpose of assisting Actinver in executing services related to your contract, as well as to fulfill judicial or administrative requirements issued by competent authorities.

  6. Third parties (business alliances); exclusively to provide you with additional products and/or services to your contract.

E. Exercising ARCO Rights.

In all legally applicable cases, you may exercise your access, rectification, cancellation, and/or opposition rights ("ARCO Rights") at any time through the procedures we have implemented.
The corresponding request must comply with the requirements set forth in the applicable legislation, by submitting a written request addressed to our Personal Data Department at the following address: Lomas de Chapultepec, IV Section, Phone: 01 (55) 86 36 55 50, Miguel Hidalgo Borough, C.P. 11000, Mexico City,
The request must include and be accompanied by the following:
    I. The name and address of the data subject or another means to communicate the response to your request.
   II. Documents that prove your identity or, if applicable, legal representation.
  III. A clear and precise description of the personal data to which any of the ARCO Rights are being exercised; and
  IV. Any other element or document that facilitates locating your personal data.
Actinver will communicate the decision within a maximum of twenty days from the date it receives the corresponding request. If the request is granted, it will be made effective within the next fifteen business days following the date Actinver communicates the response. If the information provided in your request is incorrect or insufficient, or if the necessary documents to prove your identity or legal representation are not provided, Actinver will request the correction of deficiencies within the next fifteen business days after receiving your request. In these cases, you will have ten business days to comply with the correction request, starting the day after you receive this request. The request will be considered not filed if you do not respond within that period.
You may obtain the requested information or personal data through simple copies, electronic documents in conventional formats (Word, PDF, etc.), or any other legitimate means that guarantees and proves the effective exercise of the requested right.
Alternatively, you may direct your request to the Personal Data Department of Actinver via email at unidad@actinver.com.mx or visit any of the financial centers for public attention where Actinver Group entities are located, in any case complying with all the previously listed requirements, marking the subject of the communication as "ARCO Rights and/or Consent Revocation," with the understanding that the timelines for the procedure will be the same as mentioned in this section. If the deadline specified in the Federal Personal Data Protection Law in Possession of Private Parties and its regulations passes and Actinver has not responded to your request, you may initiate the procedure for the protection of ARCO Rights before the National Institute of Transparency, Access to Information, and Personal Data Protection (INAI), whose address is located at Insurgentes Sur No. 3211, Col. Insurgentes Cuicuilco, Coyoacán Borough, C.P. 04530, Mexico City, in accordance with the requirements provided by the Institute at the appropriate time.
For Actinver, it is important to keep your personal data up to date, as well as to ensure its veracity, validity, and accuracy; therefore, we appreciate it if you notify us of any changes in your data at all times.

F. Revocation of Consent.

You may revoke your consent for the processing of your personal data at any time by sending an email to our Personal Data Department, clearly specifying the personal data, purpose, and activity you do not authorize us to carry out; provided that these data are in our databases or files, or are within our reasonable access.

The procedure for revoking consent, if applicable, will be the same as the one established in the previous section for the exercise of ARCO Rights.

G. Limitations on the use and disclosure of your personal data.

You may limit the use or disclosure of your personal data by submitting the corresponding request to our Personal Data Department. The requirements to verify your identity, as well as the procedure for handling your request, will be the same as those outlined in section E of this Privacy Notice (Exercise of ARCO Rights).

Actinver has means and procedures to ensure the inclusion of some of your data in its own exclusion lists when you request to be included in them explicitly. Actinver will provide registered individuals with the corresponding registration certificate.

H. Modifications or updates to this Privacy Notice.

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at any time and at its sole discretion. In such cases, Actinver will communicate these changes through the following website address: www.actinver.com in the section titled “Privacy Notices.”
Actinver is required to provide a new Privacy Notice when Actinver, as the Data Controller:
  1. Changes its identity;

  2. Requires the collection of additional Sensitive, Property, or Financial Personal Data not previously disclosed in this Privacy Notice, when such data is not obtained personally or directly from the data subject and requires their consent;

  3. Changes the purposes that gave rise to or are necessary for the legal relationship between Actinver and the data subject; or incorporates new purposes that require the data subject's consent, or

  4. Modifies the conditions for transfers or will make transfers not initially foreseen, and the data subject's consent is necessary.

This Privacy Notice complies with the requirements set forth by the Federal Personal Data Protection Law in Possession of Private Parties, the Regulations of the Federal Personal Data Protection Law in Possession of Private Parties, the Guidelines for the Privacy Notice, and other applicable legal provisions.

  • I give my consent for the personal data provided to Actinver to be used to contact me personally, via phone or email, for marketing, advertising, or commercial prospecting purposes exclusively by Actinver and/or its parent companies, affiliates, and/or subsidiaries, acknowledging that I do not object to the transfer of personal data to the third parties indicated therein.
