GRUPO FINANCIERO ACTINVER, S.A. DE C.V. ("Actinver") informs you, prior to obtaining your Personal Data, to enable you to exercise your rights to informational self-determination, privacy, and the protection of your Personal Data, of the following:

P R I V A C Y  N O T I C E

A. Identity and Address of the Data Controller

In accordance with the Federal Law on Protection of Personal Data Held by Private Parties (“LFPDPPP”), its regulations (“Regulations”), and other applicable provisions, GRUPO FINANCIERO ACTINVER, S.A. DE C.V. (hereinafter referred to as the "Data Controller" or "Actinver," interchangeably), with an address at Montes Urales No. 540, P.B., Colonia Lomas de Chapultepec, Delegación Miguel Hidalgo, C.P. 11000, Mexico City, Tel: +52 (55) 86 36 55 50, informs you that during the processing of your personal data, we will establish the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility established by the LFPDPPP and its Regulations.

B. Personal Data Collected and Processed.

The personal data that you voluntarily provide to Actinver through any means we make available, through publicly accessible sources, or any other lawful means (hereinafter collectively referred to as “Personal Data”), considering your rights under the Law and Regulations, may include:
a. Personal Data: Full name, address, phone numbers, photograph, Federal Taxpayer Registry (RFC), voter ID (INE), CURP, gender, nationality, place and date of birth, education level, email address, driver’s license number, professional and academic background, work experience, marital status, general family details (parents, siblings, spouses, children), current and previous employment information, personal references, and other data related to identification, physical characteristics, biometric data (such as fingerprints and facial images), academic, employment, legal, and migratory data of the same nature.
If you provide third-party personal data (e.g., family members or beneficiaries), you are responsible for informing them about the data processing and the contents of this Privacy Notice.
b. Financial and/or Asset Data: Housing Credit Number with the Institute of the National Housing Fund for Workers (INFONAVIT), Retirement Savings Administrator (AFORE), Social Security affiliation (IMSS), bank accounts and/or transactions, property relationships, gross and/or net income, average monthly expenses, debts with third parties, movable and immovable property (owned or rented) and their value, bank account number(s) and “Clabe” account numbers for electronic transfers, and other similar data.
c. Sensitive Data: Religious, social, civic, or cultural affiliations, blood type, weight, height, size, illnesses, current health status, tattoos, union membership, hobbies, recreational activities, and other sensitive data of the same nature.
To verify and ensure that the Personal Data you provide is accurate and up-to-date, Actinver may collect information from personal or employment references and other public sources such as phone directories, job boards, and public databases, among others.

C. Purposes of Processing

The Personal Data we process in accordance with this Privacy Notice will be used solely to fulfill, in the first instance, the purposes inherent in negotiating and, if applicable, establishing the commercial relationship with you, as well as the negotiations, planning, and execution of business and commercial activities that we conduct with third parties or entrusted parties who are fully identified and to whom we convey this Privacy Notice for compliance purposes. In the second instance, the data will be used for purposes that do not necessarily relate to the commercial relationship we have with you. These purposes are divided into two categories for your information:

a. Primary or Necessary Purposes:

  1. Management, control, administration, and updating of information related to Actinver's clients and their legal representatives (if applicable), necessary to conduct operations and ensure the confidentiality and security of transactions.

  2. Analysis of clients' creditworthiness and payment capacity in compliance with applicable law.

  3. Assessment of personal, employment, and financial backgrounds of Actinver’s clients in compliance with applicable law.

  4. Management, control, and administration of communications between Actinver and its clients.

  5. Monitoring, control, and evaluation for audits to ensure compliance with national and international laws and treaties.

  6. Ensuring confidentiality, transparency, and compliance with anti-money laundering, counter-terrorism financing, and sector-specific legal requirements through administrative and technical procedures.

  7. Judicial or extrajudicial collection of services provided by Actinver.

  8. Customer service and follow-up on complaints or inquiries through Actinver’s established communication channels.

  9. Statistical and historical record-keeping of Actinver’s clients and their legal representatives

b. Secondary or Non-Necessary Purposes:

  1. Sending communications about offers and new products or services provided by Actinver.

  2. Sending commercial information and offers (physical or electronic) about products or services offered by third parties.

  3. Promotion, distribution, marketing, and sale of products or services offered by Actinver's parent, affiliated, or subsidiary companies.

  4. Promotion, distribution, marketing, and sale of products or services offered by Actinver's business partners.

  5. Sending information about social events organized by Actinver.

  6. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you do not agree with the secondary purposes mentioned above, you have five (5) calendar days from the date this Privacy Notice is made available to express your refusal via email to our Data Privacy Office, contact details provided below.
You may also exercise your right to revoke consent or object to data processing at any time. If you do not express your refusal prior to providing or using your data, this will be understood as consent to these purposes.

D. Transfers of Personal Data.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients and for the purposes identified below, as well as those indicated in the previous section:

  1. Parent companies, affiliates, or subsidiaries of Actinver; for the purposes of centralized data storage, compliance with informational obligations, transparency, and anti-money laundering, as well as for statistical purposes and the historical record of clients and their legal representatives.

  2. Public organizations; federal, state, or municipal public administrations; Commissions; Institutes and/or Regulatory Entities; for the compliance with informational obligations, transparency, and anti-money laundering, as well as to comply with judicial or administrative requirements issued by competent authorities.

  3. Foreign organizations, entities, or authorities; for the compliance with requirements or requests affecting the Mexican territory or enforceable under International Treaties to which Mexico is a party.

  4. Financial Entities; for the compliance with informational obligations, transparency, anti-money laundering, and other legal provisions.

  5. Service providers; to assist Actinver in the execution of services related to your contract, as well as to comply with judicial or administrative requirements issued by competent authorities.

  6. Third parties (business alliances): with the sole purpose of providing you with additional products and/or services to your contract.

E. Exercise of ARCO Rights.

In all cases where legally applicable, you may exercise your access, rectification, cancellation, and/or opposition rights ("ARCO Rights") at any time through the procedures we have implemented.
The corresponding request must meet the requirements established by current legislation, by submitting a written request to our Personal Data Department at Guillermo González Camarena No. 1200, Floors 9 and 10, Col. Centro de Ciudad Santa Fe, Del. Álvaro Obregón, C.P. 01210, Mexico City
The request must contain and be accompanied by the following:
    I. Name and address of the data subject, or another method for communicating the response to your request.
   II. Documents that prove your identity or, if applicable, legal representation.
  III. A clear and precise description of the personal data for which you wish to exercise any of the ARCO Rights; and
  IV. Any other element or document that facilitates the location of your personal data.
Actinver will notify you, within a maximum of twenty days from the date it receives the corresponding request, of the decision made. If the request is granted, it will be made effective within the fifteen business days following the date Actinver communicates the response. If the information provided in your request is incorrect or insufficient, or if the necessary documents to prove your identity or legal representation are not provided, Actinver will request the correction of the deficiencies within the fifteen business days following the reception of your request. In these cases, you will have ten business days to address the correction request, starting the day after you receive the request. The request will be considered as not presented if you do not respond within this time frame.
You may obtain the requested information or personal data through simple copies, electronic documents in conventional formats (Word, PDF, etc.), or through any other legitimate means that guarantees and certifies the effective exercise of the requested right.
Alternatively, you may send your request to Actinver’s Personal Data Department via email at unidad@actinver.com.mxor visit any of the customer service centers where Actinver entities are located, ensuring that all the previously mentioned requirements are met, marking the subject as “ARCO Rights and/or Revocation of Consent,” with the understanding that the timelines for the process will be the same as those mentioned in this section. If Actinver does not respond to your request within the time period specified by the Federal Personal Data Protection Law and its regulations, you may initiate the ARCO Rights protection procedure before the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI), whose address is located at Insurgentes Sur No. 3211, Col. Insurgentes Cuicuilco, Coyoacán Delegation, C.P. 04530, Mexico City, in accordance with the requirements informed by said Institute in due course.
For Actinver, it is important to keep your personal data updated, as well as ensure its accuracy, validity, and correctness; we kindly ask you to inform us of any changes to your data at all times.

F. Revocation of Consent.

You may revoke your consent for the processing of your Personal Data at any time by sending an email to our Personal Data Department, clearly stating the Personal Data, the purpose, and the activity you do not authorize us to carry out; provided that such data are in our databases or files, or within our reasonable access.

G. Limitations on the Use and Disclosure of Your Personal Data.

You may limit the use or disclosure of your Personal Data by submitting the corresponding request to our Personal Data Department. The requirements to prove your identity, as well as the procedure to address your request, will be the same as those outlined in Section E of this Privacy Notice (Exercise of ARCO Rights).

Actinver has means and procedures to ensure the inclusion of some of your data in exclusion lists when you expressly request your inclusion in them. Actinver will provide the registered individuals with the corresponding registration certificate.

H. Modifications or Updates to this Privacy Notice.

Actinver may modify, update, extend, or in any other way change the content and scope of this Privacy Notice at any time and at its sole discretion. In such cases, Actinver will communicate these changes through the following web address: www.actinver.com in the section entitled "Privacy Notices."
Actinver is obligated to provide you with a new Privacy Notice when Actinver, in its capacity as Data Controller:
  1. Changes its identity;

  2. Requires the collection of additional Sensitive, Property, or Financial Personal Data other than those informed in this Privacy Notice, when such data are not obtained personally or directly from the data subject and consent is required;

  3. Changes the purposes that gave rise to or are necessary for the legal relationship between Actinver and the data subject; or new purposes are introduced that require consent; or

  4. Modifies the conditions for transfers or conducts transfers not initially planned, and consent from the data subject is necessary.
