Actinver Casa de Bolsa, S.A. de C.V., Grupo Financiero Actinver (“Actinver”), informs you, prior to the collection of your Personal Data, to enable you to exercise your rights to informational self-determination, privacy, and the protection of your Personal Data, as follows: 

P R I V A C Y N O T I C E

A. Identity and Address of the Data Controller.

In accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDPPP”), its regulations (the “Regulation”), and other applicable provisions, Actinver Casa de Bolsa, S.A. de C.V., Grupo Financiero Actinver (hereinafter, the “Data Controller” or “Actinver”), with its registered address located at Montes Urales No. 620, P.B., Colonia Lomas de Chapultepec, Tel: 01 (55) 86 36 55 50, Alcaldía Miguel Hidalgo, C.P. 11000, Mexico City, hereby informs you that during the processing of the personal data you provide, we will implement the necessary measures to comply with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and responsibility as stated by the LFPDPPP and the Regulation. 

B. Personal Data Collected and Processed.

The personal data that you voluntarily provide to Actinver by any means available to you, or that is obtained through public access channels, or other legitimate sources (hereinafter collectively referred to as “Personal Data”) may include, but are not limited to, the following:

a. Personal Data: Full name, address, phone numbers, photograph, Federal Taxpayer Registration (RFC), voter ID (INE), Unique Population Registry Code (CURP), gender, nationality, place and date of birth, education level, email address, driver’s license number, professional and academic background, work experience, marital status, general family data (parents, siblings, spouses, children), employment information (current and previous), personal references, physical characteristics, biometric data (such as fingerprints, facial image), academic records, legal data, migration data, and any other data of the same nature, exclusively under this category.

The personal data of third parties provided by you to Actinver for the fulfillment of identified purposes or secondary purposes (e.g., family or beneficiary data) should be shared only after informing them about the existence of the processing of their data and the content of this Privacy Notice.

b. Financial and/or Property Data: Housing Credit Number with the National Housing Fund Institute for Workers (INFONAVIT), Retirement Fund Administrator (AFORE), affiliation with IMSS, bank accounts and/or transactions, property relations, gross and/or net income, average monthly expenses, debts with third parties, owned or leased movable and immovable property and their value, bank account numbers and “Clabe” numbers for electronic transfers, and other data of the same nature, exclusively under this category.
c. Sensitive Data: Religious, social, civic, or cultural associations, blood type, weight, height, size, medical conditions, current health status, tattoos, union affiliation, and hobbies, entertainment, and other similar data, exclusively under this category.

For verification and consultation purposes, as well as to ensure that the Personal Data you have freely provided is correct and current, Actinver may collect information from personal references, work references, and other sources such as telephone or work directories, job boards, or publicly available databases, among others.

C. Purposes of Processing.

The Personal Data we process in accordance with this Privacy Notice will be used solely to fulfill, initially, the purposes inherent in negotiating and, if applicable, formalizing the commercial relationship with you, as well as the negotiation, planning, and execution of the business and commercial activities we conduct with third parties or responsible parties who are clearly identified and to whom we transmit this Privacy Notice for their compliance. In the second instance, the data may also be used for purposes not necessarily related to the employment relationship with you, which are divided into two categories for your information:

a. Primary or Necessary Purposes:

  1. Management, control, administration, and updating of information related to Actinver’s clients and the legal representatives of clients (in the case of legal entities), necessary to carry out and confirm transactions, contract services with Actinver, and ensure the security and confidentiality of transactions.

  2. Analysis of the quality, creditworthiness, and payment capacity of Actinver's clients, in accordance with applicable legislation.

  3. Analysis of the profile, background, work, and financial history of Actinver's clients, as required by applicable laws.

  4. Management, control, and administration of communications between Actinver and its clients.

  5. Monitoring, control, and evaluation of audits to ensure compliance with actions mandated by national, international, and international treaties to which Mexico is a party.

  6. Ensuring compliance with confidentiality, honorability, transparency obligations, as well as legal provisions related to the prevention of money laundering, terrorism financing, and other sector-specific regulations, by implementing the established administrative and technical procedures.

  7. Management, control, and administration of the judicial or extrajudicial collection of services provided by Actinver.

  8. Customer service and follow-up on complaints and/or clarifications through the communication channels established by Actinver.

  9. Statistical and historical records of clients and their legal representatives.

  10. Verification of the client's identity based on the information in their official identification documents with the National Electoral Institute and/or other public institutions responsible for such verifications, including biometric data linked to the same, to confirm identity and prevent impersonation.

  11. Collection of biometric information for storing it to perform necessary verification and comparison procedures, in compliance with legal provisions ensuring that transactions are conducted by the actual client.

b. Secondary or Non-Necessary Purposes:

  1. Sending communications about offers and new products and/or services provided by Actinver.

  2. Sending information and commercial offers (both electronic and physical) about products and/or services offered or produced by third parties.

  3. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver’s parent companies, affiliates, or subsidiaries.

  4. Promotion, distribution, marketing, and sale of products and/or services offered by Actinver’s business partners.

  5. Sending information about social events organized by Actinver.

  6. Sending information about recreational, educational, or cultural activities organized by Actinver.

If you do not agree with the above-mentioned purposes, please be informed that you have a period of no more than five (5) natural days from the date this Privacy Notice is made available to you to express your objection via email to our Personal Data Office, the details of which will be provided below.
The rights of the data subject to revoke consent or oppose the processing of their personal data remain intact if no objection is made before the data is provided or utilized.

D. Transfers of Personal Data.

Your personal data may be transferred within the national territory or abroad to the following categories of recipients and for the purposes identified below, as well as those mentioned in the previous section:
  1. Parent companies, affiliates, or subsidiaries of Actinver for purposes such as centralized data storage, compliance with informational, transparency, and anti-money laundering obligations, as well as statistical purposes and historical records of clients and their legal representatives.

  2. Public Agencies; federal, state, or municipal public administrations; commissions; regulatory institutes and/or entities, for compliance with informational, transparency, and anti-money laundering obligations, as well as judicial or administrative requirements issued by competent authorities.

  3. Foreign Entities, Agencies, or Authorities for compliance with requirements or requests affecting Mexican territory or enforceable under international treaties to which Mexico is a part.

  4. Financial Entities for compliance with informational, transparency, anti-money laundering obligations, and other legal requirements.

  5. Service Providers to assist Actinver in the execution of services related to your contract and to address and ensure compliance with judicial or administrative requirements issued by competent authorities.

  6. Third Parties (business partners) exclusively for the purpose of providing you with additional products and/or services related to your contract.

E. Exercise of ARCO Rights.

Where legally applicable, you may exercise your rights of access, rectification, cancellation, and/or opposition ("ARCO Rights") at any time through the procedures we have established.
To do so, submit a written request meeting the requirements set by applicable legislation to our Personal Data Department at the following address: Montes Urales No. 620, Piso 1, Colonia Lomas de Chapultepec, IV Sección, Alcaldía Miguel Hidalgo, C.P. 11000, Mexico City. Phone: 01 (55) 86 36 55 50.
The request must include:
     I. The full name and address of the data subject, or another means of communicating the response.
    II. Documents proving the identity of the applicant or, where applicable, legal representation.
   III. A clear and precise description of the personal data for which any ARCO Rights are being exercised
   IV. Any other information or document that facilitates locating your personal data.
Actinver will notify you of its determination within 20 calendar days from the date your request is received. If your request is granted, it will be implemented within 15 business days after Actinver communicates its response. If the information provided is incorrect or incomplete, or if required documents proving identity or legal representation are missing, Actinver will request corrections within 15 business days. You will then have 10 business days to address these corrections from the day after receiving the request. If you fail to respond within this period, your request will be considered not submitted.
You may receive the requested information in simple copies, electronic documents (e.g., Word, PDF), or any other legitimate means that ensure the requested rights are effectively exercised.
You may also submit your request via email to the Personal Data Department at unidad@actinver.com.mx, or visit any of Actinver’s financial service centers. Please include all required information and use the subject line: “ARCO Rights and/or Revocation of Consent”. The response timeline for these methods remains the same as outlined above. If Actinver fails to respond within the timeframe established by the Federal Law on Protection of Personal Data Held by Private Parties, you may file a data protection claim with the National Institute for Transparency, Access to Information and Protection of Personal Data (INAI), located at Insurgentes Sur No. 3211, Colonia Insurgentes Cuicuilco, Delegación Coyoacán, C.P. 04530, Mexico City, in accordance with the requirements set by the Institute.
Actinver values keeping your personal data up to date, accurate, and valid. Please inform us promptly of any changes to your information.

F. Revocation of Consent.

You may revoke your consent for processing your personal data at any time by submitting an email to our Personal Data Department. Your email must clearly state the personal data, the purpose, and the specific activity you are revoking consent for, as long as such data is stored in our databases or reasonably accessible to us.
The procedure for revocation is the same as that described for exercising ARCO Rights in the previous section.

G. Limitations on the Use and Disclosure of Personal Data.

You can limit the use or disclosure of your personal data by submitting a request to our Personal Data Department. The requirements to prove your identity and the procedure to process your request are the same as those outlined in Section E (Exercise of ARCO Rights).
Actinver has mechanisms and procedures to ensure the inclusion of your data in internal exclusion lists when you expressly request this. Actinver will provide registered individuals with confirmation of their inclusion in such lists.

H. Changes or Updates to this Privacy Notice.

Actinver may modify, update, extend, or otherwise change the content and scope of this Privacy Notice at its sole discretion. Any such changes will be communicated through the following website: www.actinver.com, in the section titled “Privacy Notices”.
Actinver will be required to provide a new Privacy Notice when:
  1. There is a change in its identity.

  2. Additional Sensitive, Financial, or Proprietary Personal Data is to be collected beyond what is detailed in this Privacy Notice, especially when this data is not directly obtained from the data subject and requires explicit consent.

  3. The purposes for processing data that established or are necessary for the legal relationship between Actinver and the data subject are modified, or if new purposes requiring consent are added.

  4. The conditions for data transfers are modified, or new transfers not previously outlined are introduced, requiring consent from the data subject.

This Privacy Notice complies with the requirements set forth in the Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, the Privacy Notice Guidelines, and other applicable legal provisions.
